Over the past few days, I have heard the same question over and over again:

"Is Adjustment of Status over?"

If you spend any time on social media, immigration forums, or WhatsApp groups, you have probably seen alarming headlines suggesting that USCIS has practically eliminated Adjustment of Status (AOS) and that most people will now be forced to leave the United States and complete their immigrant visa process abroad.

As an immigrant myself, I understand why so many people are worried. Immigration is already stressful enough without waking up to headlines that make it sound like the rules changed overnight.

So let's take a step back and talk about what actually happened.

What Did USCIS Announce?

On May 21, 2026, USCIS issued a new policy memorandum regarding Adjustment of Status. The memo emphasizes that Adjustment of Status is a discretionary benefit and not an automatic right, even when an applicant appears to meet the legal requirements. USCIS also described Adjustment of Status as an "extraordinary" form of relief that allows applicants to complete their green card process from within the United States instead of through a U.S. consulate abroad.

That language immediately caught the attention of immigration attorneys and immigrant communities across the country.

Why?

Because for decades, Adjustment of Status has been one of the most common pathways used by eligible immigrants already present in the United States to obtain permanent residence.

Why Did People React So Strongly?

The concern was not necessarily about what the memo explicitly changed.

The concern was about what the memo could signal.

The memorandum repeatedly emphasizes officer discretion and suggests that USCIS may issue additional guidance for specific categories of applicants in the future. Many practitioners interpreted this as a sign that Adjustment of Status cases could face increased scrutiny moving forward.

For many immigrants, the fear was simple:

"If Adjustment of Status is now considered extraordinary relief, does that mean most cases will be denied?"

That fear quickly spread online, and some people began interpreting the memo as if Adjustment of Status had effectively ended.

Did the Law Change?

No, and this is probably the most important point in the entire discussion.

The policy memorandum did not change the underlying immigration statutes. It did not eliminate Adjustment of Status. It did not remove eligibility categories. It did not create new filing requirements. It did not prohibit people from filing Adjustment of Status applications if they otherwise qualify.

In other words:

If you were eligible to file Adjustment of Status before the memo, you are generally still eligible to file Adjustment of Status after the memo.

Then Why Is Everyone Talking About Discretion?

Because discretion matters.

Many people assume that once all forms are filed and all eligibility requirements are met, approval is guaranteed.

That has never been entirely true.

Immigration officers have always had some level of discretionary authority in certain immigration benefits. What this memorandum does is place a renewed emphasis on that concept and remind officers that Adjustment of Status should involve a discretionary review, not simply a checklist review.

Whether that emphasis will lead to measurable increases in denials remains to be seen. At this point, nobody has enough data to honestly answer that question.

What I Believe This Memo Really Signals

The thoughts below reflect my personal observations based on conversations with immigration professionals, discussions within the immigration community, and publicly available commentary regarding the memorandum. What does seem clear is that USCIS is signaling an expectation that applications be thoroughly documented, carefully prepared, and capable of withstanding a more detailed review process than many applicants may have experienced in the past.

Whether your case appears simple or highly complex, preparation matters.

Today, working with qualified and properly licensed immigration professionals is no longer something that should be viewed as a luxury reserved for difficult cases; it is often a form of prevention.

It is an opportunity to identify potential issues early, understand what evidence may be needed, and make sure your application is prepared as thoroughly as possible before it reaches an officer's desk.

No professional can guarantee approval; No professional can eliminate uncertainty.

But proper legal guidance can help you understand the risks, the requirements, and the options available to you before important decisions are made.

And in today's immigration environment, that preparation may be more valuable than ever.
